1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "you") and Masalya Foods Pvt. Ltd. ("Masalya", "we", "us", or "our"), governing your use of our website masalya.com and any related services.

By using our Site, you confirm that you are at least 18 years of age, or are accessing the Site under the supervision of a parent or legal guardian, and that you have the legal authority to agree to these Terms.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Continued use of the Site after any such changes constitutes your acceptance of the new Terms.

Product Descriptions

We make every effort to display our products as accurately as possible. However, we do not guarantee that product descriptions, images, pricing, or other content on the Site is accurate, complete, or current. Product packaging and labels may differ from images shown on the Site.

Pricing

All prices are listed in Indian Rupees (₹) unless otherwise stated. Prices are subject to change without notice. We reserve the right to refuse or cancel orders if pricing errors occur.

• All prices are inclusive of applicable GST (taxes are included in the displayed price)
• Shipping charges are additional and are calculated at checkout
• International orders may be subject to import duties and taxes, which are the responsibility of the buyer
• Promotional pricing is valid only for the stated duration

Availability

All products are subject to availability. We reserve the right to limit quantities or discontinue products at any time. If a product is out of stock after your order is placed, we will notify you and provide options for substitution, delay, or refund.

3. Orders & Payment

Placing an Order

By placing an order, you represent that the information you provide is accurate, complete, and current. We reserve the right to refuse any order and to cancel orders at our discretion, including for reasons such as fraud, payment failure, or product unavailability.

Order Confirmation

You will receive an email confirmation when your order is received. This confirmation does not constitute acceptance of your order. Acceptance occurs when your order is dispatched and a shipping notification is sent.

Payment

We accept major credit/debit cards, UPI, net banking, and other payment methods as listed at checkout. Payment is processed securely through our PCI-DSS compliant payment gateway. We do not store card details on our servers.

4. Shipping & Delivery

Domestic Shipping (India)

• Standard delivery: 3-7 business days depending on location
• Express delivery: 1-3 business days (available in select cities)
• Free shipping on orders above ₹799
• Orders placed before 2:00 PM IST on business days are typically dispatched the same day

International Shipping

• We ship to 25+ countries. Delivery times vary by destination (typically 7-21 business days)
• International shipping rates are calculated at checkout
• Import duties, taxes, and customs fees are the sole responsibility of the recipient
• We are not responsible for delays caused by customs authorities

Risk of Loss

The risk of loss and title for products purchased from us passes to you upon delivery to the carrier. We are not responsible for loss or damage that occurs during transit once the package has been handed to the carrier.

5. Returns & Refunds

Return Policy

We accept returns within 7 days of delivery for the following reasons only:

• Product received is damaged, defective, or spoiled
• Wrong product was delivered
• Product packaging is tampered with or unsealed upon delivery

Due to the nature of food products and hygiene regulations, we do not accept returns for "change of mind" or if the product has been opened and consumed, even partially.

Refund Process

To initiate a return, contact us at hello@masalya.com with your order number and photos of the damaged/incorrect product within 7 days of delivery. Approved refunds will be processed within 5-10 business days to the original payment method.

6. Intellectual Property

All content on this Site - including but not limited to text, graphics, logos, images, product photographs, button icons, audio clips, and software - is the property of Masalya Foods Pvt. Ltd. or its content suppliers and is protected by Indian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, display, sell, lease, transmit, modify, create derivative works from, or otherwise use any content from this Site without our express written permission.

The "Masalya" name, logo, and tagline "Sure for Pure" are registered trademarks of Masalya Foods Pvt. Ltd. Unauthorised use is strictly prohibited.

7. Prohibited Uses

You agree not to use our Site or Services for any of the following purposes:

• Any unlawful purpose or in violation of any applicable law or regulation
• Transmitting or procuring the sending of any unsolicited commercial communications

• Any bugs, viruses, or other harmful code transmitted through our Site
• The accuracy, completeness, or reliability of any content on the Site

Our total liability to you for any claim arising out of or related to these Terms or our Services shall not exceed the amount you paid for the specific product(s) that gave rise to the claim.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Surat, Gujarat, India.
